Srinagar, May 22, KNT: Jammu Kashmir High Court has directed Superintendent Central Jail Agra, in Uttar Pradesh to ensure the hassle-free appearance of a Class 12th detenue in the upcoming bi-annual examination in Kashmir Valley.
Saliq Parvez son of Parvez Ahmed Bhat, a resident of Gagren Shopian is currently lodged in Agra Central Jail of Uttar Pradesh. He had been booked by Jammu Kashmir Police under Public Safety Act in January this year after arresting him on charges of stone-pelting.
The Counsel for the detenue, Advocate Bashir Ahmed Tak as per news agency Kashmir News Trust had petitioned before the court of Justice Moksha Khajuria Kazmi, that Saliq Parvez has to appear in the examination of Higher Secondary Part-II Bi-Annaul conducted by J&K Board of School Education from May 25 this month.
The Counsel had submitted that the Admit Card issued on this behalf by the Board of School Education reflects that the detenue Saliq Parvez has been allotted the Roll No. 37104487.
“It is stated that the detenue has been detained under the provisions of the Public Safety Act and is presently lodged in Central Jail Agra (UP) India. The examination is scheduled to commence on 25″ May 2022, as per the Date Sheet,” Advocate Bashir Ahmed Tak submitted adding that the detenue will suffer badly in case he is not allowed to appear in the examination.
The court of Justice Moksha Khajuria Kazmi after hearing the arguments directed Superintendent Central Jail Agra, in Uttar Pradesh to ensure the hassle-free appearance of the detenue and also asked the Secretary, Board of School Education, J&K to ensure compliance of the court order.
The court further maintained that the respondents can alternatively facilitate the virtual appearance of the detenu in the scheduled examination if his physical appearance is found to be impossible for any unavoidable reason. In both the cases, however, the detenue should be facilitated hassle-free appearance in the examination. (KNT)
