Court declines to release convicted driver on probation

 

Srinagar, Nov 28, KNT: A local court declined to release a driver convicted in a road accident case on probation.

The court of Judicial Magistrate, Uri, Ms. Fozia Paul, declined to release the driver Naseer Ahmad Kali for his involvement in a fatal road accident that occurred on June 27, 2014, in Thajal Balakot area of Uri in North Kashmir’s Baramulla district. The accident resulted in the deaths of three passengers while 12 passengers had sustained injuries.

The prosecution as per the news agency Kashmir News Trust stated that the vehicle, a Trex bearing registration number JK05B-8962, was traveling from Uri to Thajal when it went out of control and fell into a deep gorge due to the driver’s negligence and rash driving.

The court charged him under sections 279, 337, 338, 304-A, and 427 of the RPC, as well as sections 3/181 and 113/194 of the Motor Vehicles Act.

The Council for the accused had sought the release of the accused on probation. However, the court found him negligent and guilty and refused to release him on probation, citing the devastating consequences of road accidents in Kashmir Valley.

The court ordered the accused to be sent to Sub Jail Baramulla to serve his imprisonment. A copy of the judgment was provided to the accused free of cost, and the challan was disposed of and consigned to records. [KNT]
